Terms & Conditions

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE OR WEBSITE PRODUCTS.
All users of this site and services of Hyperlinks Media must agree that access to and the use of this site and its products are subject to the following terms and conditions.

Development Time Schedule – Development time schedule is as important to you as a client as it is to us as a web development company. Once you have paid your down payment, you will be given an approximate start date of your website design. During this time you may request for us to set up the server with your domain name so you may begin using your domain emails immediately. During this time, we urge you to send us all of the content you want on your website such as logo, text content, PDF's, videos, pictures, etc. Most of this information must be given to us BEFORE your start date in order for our designers to understand your website concept and develop a proper layout according to your information supplied. Delay in getting us this information before your start date will move your website to the end of the line and you will be placed at the next start date. This could delay your start date by another week or more. If most of the information needed to start your website has been sent to us, we will begin the website on your start date. ALL your information must be received within 30 days after the start date. Once we have completed your website with all of the information you have given us, we will bill you the balance. If some material is not recieved after 30 days of our completion date, you will be billed the balance of the website development even if the website is not complete due to us not receiving all of your information. (Example: We complete your website and you only have text for 1 page that is left not completed and it has been over 30 days since we finished, we will bill you balance of website due. After that you have 30 days to get us the text that was not completed.) Information received after 30 days will be billed as an "update" fee. This is why it is important to send us all of your information as soon as possible.

Website Balances – Once we have completed your website project, whether your website is "live" or not, we will send you the balance of your website. You will have 2 week to look over your website and let us know of any modifications that you would like performed within the scope of the job listed on your invoice. After 2 week, any modifications will be billed as updates so it is important that you review as soon as possible.

Hosting – Hosting will be set up once you approve your layout design and we begin coding. You may also request for it to be set up immediately to begin to use your emails. In order to set up hosting, your credit card will be billed a prorated amount plus the one-time $35.00 server set-up fee. Monthly payments are required by credit card. Semi annual and annual payments can be made by credit card or check. Annual payments will receive 1 month free. When 11 months are paid in advance you will receive 12 months of hosting. When paid in advance, there is no refund of unused hosting. Cancellation of hosting must be made prior to the 1st of the month; otherwise the hosting for that month is due on the 1st. There is no refund for the unused portion of that month. If hosting has not been made on the first and is not paid within 30 days, hosting will terminate. Once terminated, a $35.00 server set-up fee and the last month hosting fee is due in order to reestablish hosting. After 120 days, all files will be terminated from our system. This includes website and database files.

Emails – Emails refers to emails that are for your business employees only. This excludes 3rd party associates outside of your business, or affiliates, or any other type of individual that is not a bona fide employee. Some exceptions are made for spouse or immediately family members. Email space must be reduced in each mail box on the server on a regular basis through deletion of emails via web mail or downloaded with programs such as outlook. The email server is not meant to be email storage. You are responsible for downloading your messages and saving them.

Third-Party Links – In an attempt to provide increased value to our visitors, Hyperlinks Media may link to sites operated by third parties. However, even if the third party is affiliated with Hyperlinks Media, Hyperlinks Media has no control over these linked sites, all of which have separate privacy and data collection practices independent of Hyperlinks Media. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Hyperlinks Media seeks to protect the integrity of its website and the links placed upon it. Therefore, Hyperlinks Media requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).

Transfer website – There is a minimum of a $75.00 fee to transfer website and database files to another server. We are not responsible for any files once transferred.

Images – ALL IMAGES ON YOUR WEBSITE ARE YOUR RESPONSIBILITY. We will offer you images at no charge that we purchase from www.istockphoto.com or other 3rd party vendors that allow us to do so.  These are not for resale and will be supplied for free. However, we may charge an installation fee of the image. Images that you supply us to place on your website are 100% your responsibility. Any and all copyright law violation are 100% your responsibility.  

Text Content – ALL TEXT CONTENT ON YOUR WEBSITE IS YOUR RESPONSIBILITY. All text content must be supplied by you. Any content written by us and placed on your site must be reviewed by you and is ultimately your responsibility. You must from time to time review your website to make sure all content is up-to-date and valid. Any disputes or copyright violations are 100% your responsibility.

Transmitted Data – ALL DATA TRANSMITTED ON YOUR WEBSITE IS YOUR RESPONSIBILITY. We will provide you the information and cost for secure data transmission. It is your responsibility to purchase that security from us or another party to have installed to provide secure transmission. If purchased from us, we will notified you of expiration dates of said security measures so they may be renewed. If purchased from another party, it is your responsibility to renew your security measures and notify us.

Online Payments Data – ALL ONLINE PAYMENT DATA TRANSMITTED ON YOUR WEBSITE IS YOUR RESPONSIBILITY.  We will provide you the information and cost for secure data transmission. It is your responsibility to purchase that security from us or another party to have installed to provide secure transmission. If purchased from us, we will notified you of expiration dates of said security measures so they may be renewed. If purchased from another party, it is your responsibility to renew your security measures and notify us.

Email Data – ALL EMAIL DATA TRANSMITTED ON YOUR WEBSITE IS YOUR RESPONSIBILITY. We will provide you the information and cost for secure data transmission. It is your responsibility to purchase that security from us or another party and have it installed to provide secure transmission. If purchased from us, we will notified you of expiration dates of said security measures so they may be renewed. If purchased from another party, it is your responsibility to renew your security measures and notify us.

SEO – Monthly payments are required by credit card. Semi Annual and Annual payments may be made by credit card or check. Annual payments will receive 1 month free. When 12 months are paid in advance you will receive 13 months of hosting. When paid in advance, there is no refund of unused SEO. Cancellation of SEO must be made prior to the 1st of the month; otherwise the SEO for that month is due on the first. There is no refund for the unused portion of that month. If SEO has not been made on the first and is not paid within 30 days, SEO will terminate. Once terminated, all SEO will be removed from website.  

Graphic Design – All graphic design created and purchased through Hyperlinks Media will be sent to you in its native file with the ability to be updated. It will also be saved by us and made available for 120 days. After 120 days it will be deleted from our system. If you host your website with us, we will continue to save your graphic files for as long as you host with us. In addition, we will make them available on a link from your website.

Hold Harmless and Indemnify – You agree to hold  harmless and indemnify Hyperlinks Media and all its employees, agents, and representative from any and all claims arising out of any content or material on your website. It is your responsibility to from time to time review your website to make sure all content and material is up-to-date and valid. 

Disputes - If any action is warranted by either party, both parties agree to settle through arbitration and to work out any argument under the rules of the American Arbitration Association. The prevailing party will not be responsible for fees of arbitratration and the party against whom judgement is made will be responsible for all fees and entitled damages.

Govorning Law - The validity of this Agreement and any of its term or provisions, as well as the rights and duties of the parties hereunder, shall be governed by the laws of the State of Texas.

Entire agreement – Except as expressly stated herein, the terms of service constitutes the entire agreement between you and Hyperlinks Media with respect to the services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and Hyperlinks Media with respect to the services.

Acknowledgement – By using the website and services offer by Hyperlinks Media you acknowledge that you have read these terms of service and agree to them.
